Abstract PL
Pierwszy obejmuje wyszukiwanie, streszczanie i analizowanie przepisów, orzeczeń i piśmiennictwa.
Abstract EN
This article asks what role computational tools can play in the reconstruction of a legal norm without taking over decisions reserved for the interpreter. It starts from a critical analysis of Andrzej Porębski’s study, which sets out the arguments for taking the semantic analysis of general language into account in legal interpretation. The authors accept those findings and undertake the task Porębski deliberately left aside: showing how the postulate can be carried out. The methodological model proposed here rests on a distinction between two ways of using computational tools. The first covers searching, retrieving, summarising and analysing legislation, case law and legal scholarship. The second, more far-reaching, consists in subjecting the corpus of legal texts itself to semantic processing and organising it as a representation of normative material for further reconstruction. The model draws on semantic embeddings, vector search, legal ontologies, large language models and retrieval-augmented generation. The usefulness of this approach is demonstrated on material from a research activity funded by the National Science Centre, Poland, in which a corpus of more than 150,000 legal acts was searched using a language model trained on Polish. The study showed that the same entity is designated differently across individual normative acts, with no cross-references between them, and it further revealed terminological divergences and gaps that could not have been established by traditional methods given the volume of the material. Combining the computational results with classical doctrinal analysis made it possible to formulate conclusions addressed primarily to those responsible for shaping the regulation. These findings support a conclusion about the limits of computational assistance. Those limits are set by the material on which the tools operate, in the case analysed here the text of an editorial unit of a legal provision. The tools can prepare this resource: point to relations between provisions and mark the places where a decision is required, though that decision should always remain with the one who interprets.
