The commentary critically reviews the judgment of the Supreme Court wherein the said court held as invalid a guaranty contract obligating the debtor to redress the damage incurred by the creditor as a result of such debtor’s guarantee (that a third party would not revoke a commercial power of attorney) failing to materialise. The author also criticises the Supreme Court’s view that the guarantor’s declaration as to the third party’s expected behaviour may be treated as such guarantor’s promise to perform.
