The following commentary discusses the Supreme Court’s cassation judgment of 23 May 2023 concerning the cassation appeal in the so-called Brest trial. The judgment is analysed not from a purely dogmatic position but from an interdisciplinary perspective as well. The reason for this is that the judgment in question has the potential to influence phenomena in the area of law and politics, particularly the issue of the legal regulation of official memory narratives in Poland.
