Russia’s war in Ukraine has once again put the United Nations’ role in a specific area of peacemaking and the prevention of violence on the agenda. In the background negotiations about a possible truce between Russia and Ukraine, the United Nations and its current secretary-general do not play a major role (different from his role in the Black Sea grain deal), while the international debate about post-conflict justice in Ukraine focuses on non-UN institutions such as a Special Tribunal for Russia, the International Criminal Court, and the application of universal jurisdiction by domestic criminal courts. However, the United Nations has a considerable and long-lasting tradition and capacity in post-conflict solutions to justice, in the prevention of violence, and in advising countries (governments and civil society) in political transition from dictatorship to democracy and from violent conflict to peace. This chapter argues in favour of reinvigorating this tradition through self-limitation of the United Nations’ foreground institutions in international justice and instead supporting the existing non-UN judiciary institutions.
