Dynamiczny rozwój generatywnej sztucznej inteligencji (GenAI) stawia przed prawnikami nowe wyzwania etyczne, wymuszając reinterpretację dotychczasowych standardów profesjonalnych w warunkach cyfrowej transformacji praktyki prawniczej. Artykuł ma na celu porównanie polskich, europejskich i amerykańskich standardów etycznych dotyczących korzystania z narzędzi AI przez prawników, ze szczególnym uwzględnieniem pięciu płaszczyzn: kompetencji zawodowej i należytej staranności, poufności i ochrony danych, relacji z klientem, obowiązków wobec sądu oraz wewnętrznych procedur kancelarii. Analiza obejmuje opinię Amerykańskiego Stowarzyszenia Prawników (ABA Formal Opinion 512), wytyczne Rady Adwokatur i Stowarzyszeń Prawniczych Europy (CCBE) oraz polskie Rekomendacje Krajowej Izby Radców Prawnych (KIRP). Pomimo odmiennych podstaw normatywnych, analizowane standardy łączy wspólna zasada nieprzenoszalności odpowiedzialności zawodowej na narzędzie AI. Polskie rekomendacje wykazują najsilniejsze zakotwiczenie w prawie unijnym (AI Act, RODO), amerykańskie opierają się na Modelowych Zasadach ABA, europejskie zaś podkreślają znaczenie ustawicznego kształcenia. We wszystkich badanych systemach prawnik zachowuje pełną odpowiedzialność za rezultat pracy, niezależnie od zaangażowania AI.
Abstract EN
The rapid advancement of generative artificial intelligence (GenAI) presents the legal profession with new ethical challenges, requiring established professional standards to be reinterpreted in the context of the digital transformation of legal practice. This article compares the ethical standards governing lawyers’ use of AI tools in Poland, Europe and the United States, focusing on five key areas: professional competence and due diligence; confidentiality and data protection; client relations; duties towards the court; and internal law firm procedures. The analysis covers American Bar Association (ABA) Formal Opinion 512, the Council of Bars and Law Societies of Europe (CCBE) Guide on the use of generative AI by lawyers, and the Polish National Bar Council of Legal Advisors (Krajowa Izba Radców Prawnych, KIRP) Recommendations. Despite their normative foundations differing, all three frameworks share the principle that professional responsibility for work product cannot be transferred to an AI tool. The Polish recommendations are most firmly grounded in EU law (the AI Act and GDPR), the American standards rely on the ABA Model Rules and the European approach emphasises continuing legal education. In all examined systems, lawyers are fully accountable for the outcome of their work, regardless of the degree of AI involvement.
