The object of this article is to analyse and comment on selected provisions of EU and national law relating to the legal position and, in particular, the legal protection of the creditor in the situation of the assertion of cross-border claims within the European Union under the European order for payment procedure. This part of the monograph attempts to demonstrate that despite the wide range of procedures and remedies available to creditors in EU Member States, created under the provisions of secondary law of the European Union as alternative means of vindicating their claims in civil and commercial matters, they still use these legal instruments relatively rarely and the awareness of EU citizens in this respect is limited. Although they are said to be among the procedurally uncomplicated procedural remedies, practice in this regard varies across jurisdictions.
