The author refers critcally to the Supreme Court’s qualification of a contract of sale of an insurance receivable from compensation as an assignment contract regarding such a receivable. The assignment contract is a dispositional legal transaction, whereas it arises from the facts of the case that the injured person and the claimant entered into a contract obliging one party to transfer the said receivable in exchange of the other party’s obligation to pay a price for that receivable. Therefore, the parties entered into a sales contract, and not an assignment contract of a dispositional nature. Furthermore, the author points out that the compensation of damage sustained by the injured party cannot boil down to purely the value of the vehicle’s repair works, but should also compensate for the difference between the market value of an undamaged vehicle and the value of a vehicle that has been repaired.
