Celem artykułu jest ustalenie na czym polega zbieg uprawnień do zasiłku stałego, renty socjalnej i wybranych świadczeń dla opiekunów oraz dokonanie oceny, czy zasadne jest utrzymanie reguły określającej rozstrzygnięcie tego zbiegu, jak to czynią obowiązujące przepisy. Główna teza sprowadza się do stwierdzenia, że uprawnienia do powyższych świadczeń w praktyce ze sobą nie konkurują, a przepisy odnoszące się do omawianej problematyki nie podążają za zmianami w systemie prawa. Konieczna jest nie tylko ich zmiana, ale i ponowne przemyślenie koncepcji zakazu kumulowania zasiłku stałego ze świadczeniami dla opiekunów.
Abstract EN
The aim of this article is to analyze the situation of combined entitlements to permanent allowance, social pension and selected benefit for carers, and to assess whether it is reasonable to maintain the principle of their non-combination , as currently legislated. The main thesis is that the aforementioned benefits do not duplicate each other in practice and that the regulations pertaining to the discussed issues do not keep up with changes in the legal system. It is necessary not only to update the regulations, but also to rethink the concept of non-combination of permanent allowance with benefits for carers.
