Sprawowanie przez gminy opieki nad kotami. Wybrane zagadnienia.

dc.abstract.enThe aim of this article is to analyse the responsibilities of Polish municipalities in caring for cats (Felis catus), which currently represent the second most commonly kept domestic animal in Poland, and the most numerous group among homeless animals. Under the provisions of the Animal Protection Act of 21 August 1997, municipalities are entrusted with the care of both stray and free-living cats. However, as highlighted in the Supreme Audit Office report (No. 103/2024/P/24/093/LZG) published in December 2024, this responsibility is frequently not properly fulfilled. Numerous legal and practical concerns persist regarding the scope and implementation of this duty, including the classification of cats and the management of their populations. The findings reveal significant deficiencies, indicating that the care provided does not ensure humane treatment of these animals. The article outlines key problems and formulates conclusions that may serve as a basis for further research in the field of cat protection, as well as for developing de lege ferenda proposals to improve the relevant legal framework.
dc.abstract.plCelem prezentowanego artykuƂu jest analiza problemu sprawowania przez gminy opieki nad kotami (Felis catus), ktĂłre obecnie stanowią drugą co do wielkoƛci grupę zwierząt utrzymywanych w polskich domach, zaƛ pierwszą jeƛli chodzi o liczbę zwierząt bezdomnych. Przepisami ustawy z 21.08.1997 r. o ochronie zwierząt opiekę nad kotami bezdomnymi i kotami wolno ĆŒyjącymi przekazano gminom, jednak – jak wynika z raportu NajwyĆŒszej Izby Kontroli z grudnia 2024 r. (nr 103/2024/P/24/093/LZG) – opieka ta nie jest wƂaƛciwie realizowana, jak teĆŒ powstaje wiele wątpliwoƛci co do jej zakresu i sposobu realizacji, zasad klasyfikowania kotĂłw i zarządzania ich populacją. Wnioski ujawniają problemy prawne i praktyczne, a sposĂłb realizacji opieki nie zapewnia tym zwierzętom humanitarnego traktowania. W artykule przedstawione zostaƂy problemy i wnioski, ktĂłre mogą stanowić bazę do dalszych badaƄ dotyczących ochrony tej grupy zwierząt, jak rĂłwnieĆŒ opracowania postulatĂłw de lege ferenda.
