Niniejszy rozdział podejmuje analizę kluczowej roli systemów identyfikacji podmiotów prawnych w kształtowaniu współczesnego governance oraz zarządzania danymi, ze szczególnym uwzględnieniem systemu Legal Entity Identifier (LEI). Przedstawiono ewolucję form ustrojowych – od starożytnego Rzymu po erę cyfrową – wskazując na wpływ przemian technologicznych, paradygmatu opartego na danych oraz decentralizacji procesów decyzyjnych. Punktem odniesienia dla rozważań jest koncepcja „prawa jako osiągnięcia governance” autorstwa L.A. Kornhausera, wedle której normy prawne mają charakter dynamiczny i konstytuują się w ramach efektywnych struktur zarządzania. Podkreślono, że system LEI sprzyja przejrzystości, zgodności regulacyjnej oraz efektywności w transakcjach finansowych i prawnych o zasięgu globalnym. W końcowej części sformułowano postulaty integracji LEI z krajowymi i międzynarodowymi porządkami prawnymi, jako warunku zwiększenia precyzji, inkluzywności i zrównoważonego charakteru współczesnego governance.
Abstract EN
This chapter examines the critical role of legal entity identification systems in shaping modern governance and data management, focusing on the Legal Entity Identifier (LEI). It explores the historical evolution of governance from Ancient Rome to the present, highlighting the impact of technological advancements, data-centric frameworks, and decentralized decision-making processes. The discussion draws from Kornhauser’s “Law as an Achievement of Governance” concept, underscoring how legal norms emerge as dynamic outcomes of effective governance structures in a data-driven world. The chapter emphasizes how LEIs promote transparency, regulatory compliance, and efficiency in global financial and legal transactions. Recommendations for further integration of LEI into national and international legal frameworks are provided, offering pathways for enhancing governance precision, inclusivity, and sustainability in the face of complex global challenges.
