The article addresses an issue related to the law of evidence in criminal proceedings, specifically evidentiary prohibitions related to the legal obligation to maintain various forms of secrecy. The detailed considerations focus on the secrecy of the deliberation room, which is binding on the members of the adjudicating panel, and the possibility of disclosing such secrecy in ways other than by issuing a dissenting opinion when signing the judgment. The primary question explored is whether the disclosure of this secret by a judge, who is the accused in criminal proceedings, as part of their right to defence is lawful.
