In recent years, the world has been facing the SARS-CoV-2 virus epidemic causing the infectious COVID-19 disease. Its appearance poses a very big challenge not only to modern medicine, but also to public authority, which has to deal with appropriate planning and organization of the battle against the epidemic, as well as the selection of adequate means to do so. One of the most important factors for an effective fight against an epidemic is the human factor, which is why the legislator has provided for the possibility of appointing certain people to fight the epidemic. The considerations made in this article will help to answer the question whether the regulation imposing an obligation to work on a given person is compliant with the basic law, and whether the procedure and organization of the procedure selected by the legislator on this subject meet the relevant criteria. The conducted analysis, despite the general statement that the principle of appointing a given person to combat an epidemic is compliant with the basic law, reveals significant shortcomings related to the nature of the administrative decision or the proceedings conducted by the authorities that require an appropriate response from the legislator.
