dc.abstract.enThe author conducts a detailed analysis of the constitutional aspects of the process of the President of the Republic of Poland assuming office, while drawing attention to the formalities related to the assumption of full executive power and the role of state authorities in ensuring the continuity of power. The article also discusses key issues concerning the procedure whereby the validity of elections is determined by the Supreme Court, emphasizing the importance of maintaining compliance with the Constitution in the context of possible procedural problems. Issues related to the assumption of the office of the President of the Republic of Poland after the end of the term of office of his/her predecessor are also indicated. In this context, the article stresses the role of the Marshal (Speaker) of the Sejm in ensuring continued functioning of the state in the event of the President-elect not being able to take office. The author emphasizes the fact that the validity of a presidential election can only be determined by the Supreme Court and points to the need to enact an appropriate statute to tackle the possible difficulties in satisfying the requirements pertaining to the composition of the Supreme Court in Article 45(1) of the Constitution.
