dc.abstract.enWhether algorithms applied by public authorities in the context of automated performance of public tasks constitute public information remains a controversial issue. In the present case, the Supreme Administrative Court referred directly to the above issue, recognising that an algorithm constitutes public information if it is strictly related to the func􀆟 oning of a public authority. The Court’s position comes down to recognizing that, in the case of processes of automated decision-making by a public authority, the underlying algorithm constitutes information about the architecture of such a process, i.e. which data are processed, what sources the data come from, what the processing parameters are, as well as what operations are carried out as part of processing. This conclusion is fully justifi ed by a teleological interpretation of Article 6(1)(3) of the Access to Public Information Act.
