Wśród kwestii dotyczących stanów nadzwyczajnych na pierwszy plan wysuwają się te dotyczące ich treści oraz – ewentualnie – procedury ich wprowadzania. Stosunkowo mniej uwagi poświęca się zwykle innym dotyczącym ich zagadnieniom prawnym. Jednym z takich zagadnień jest problematyka wyrównywania strat majątkowych wynikających z ograniczania w czasie stanów nadzwyczajnych praw człowieka. Tematyka ta, jak się wydaje, nie została do tej pory dostatecznie opracowana w doktrynie prawa. W związku z tym przedmiotem niniejszego artykułu jest analiza rozwiązań prawnych dotyczących wyrównywania strat majątkowych wynikających z ograniczenia w czasie stanu nadzwyczajnego praw i wolności człowieka i obywatela. Zasadniczym celem badawczym jest zweryfikowanie, czy regulacje prawne poświęcone tej problematyce zostały ukształtowane właściwie, a w szczególności czy – przynajmniej potencjalnie – nie wpływają one niekorzystnie na proces decyzyjny dotyczący wprowadzenia stanu nadzwyczajnego. Dostrzeżenie przez autora wad w tym zakresie pozwoliło na sformułowanie odpowiednich wniosków de lege ferenda, które zostały zamieszczone w zakończeniu.
Abstract EN
Among the issues relating to extraordinary states, those concerning their content and – possibly – the procedure to be introduced. Relatively less attention is usually paid to other legal issues concerning them. One of these is the issue of compensation for property losses resulting from the limitation of human rights during extraordinary states. This topic does not seem to have been sufficiently elaborated in the legal doctrine so far. Therefore, the subject of this article is the analysis of legal solutions concerning the compensation of property losses resulting from the limitation of the human and civil rights and freedom in the time of the extraordinary state. The fundamental research objective is to verify whether the legal regulations devoted to this issue have been shaped properly and in particular, whether – at least potentially – they do not adversely affect the decision-making process concerning the introduction of the extraordinary state. The relevant de lege ferenda conclusions included in the summary are the result of the Author’s insight into inconsistencies in that matter.
