Jedną z podstawowych zasad demokratycznego systemu prawnego jest kadencyjność organów, tak władzy wykonawczej, jak również organów stanowiących. Dotyczy ona nie tylko organów centralnych, ale także tych, które znajdują się na niższym – samorządowym szczeblu administracji. Warto podkreślić, iż funkcjonowanie organów na obu szczeblach jest zupełnie inne, a w szczególności sposób ich powoływania, jak również zaangażowanie i świadomość społeczna różni się od siebie w sposób diametralny. W efekcie niezbędnym jest przeprowadzenie analizy, czy obowiązujące regulacje implikujące ograniczenie liczby kadencji wykonawczych organów samorządowych nie powinny zostać zmodyfikowane, a jeśli tak, to czy taka zmiana byłaby zgodna z obowiązującą konstytucją, w tym istotą i znaczeniem jednostek samorządowych w strukturze państwa
Abstract EN
One of the fundamental principles of a democratic legal system is the term limits for both executive and legislative bodies. This applies not only to central bodies but also to those at the lower, local government level. It is worth emphasizing that the functioning of these bodies is completely different, particularly the method of their appointment, as well as their involvement and public awareness. Consequently, it is necessary to analyze whether the current regulations implying term limits for executive local government bodies should be modified, and if so, whether such a change would be consistent with the current constitution, including the nature and importance of local government units in the structure of the state.
