dc.abstract.enIn the commented judgment, the Supreme Administrative Court questioned the possibility of annulment of the local spatial development plan based on Article 54(3) of the Administrative Court Proceedings Act. An analysis of the Court’s position indicates that the normative phrase used in Article 54(3) of the Act, namely ‘may grant the appeal in full’, means that the authority applies its rules of applicable procedure to the given legal form of ‘dealing with the case’. In the absence of a regulation authorizing the municipal council to annul the local spatial development plan, the council is not permitted to make such a decision invoking the self-reviewing powers referred to in the Administrative Court Proceedings Act.
