dc.abstract.enThe subject of this commentary is the judgment of 11.01.2024, in which the Constitutional Court examined the possibility of holding the President of the NBP accountable to the Tribunal of State by a resolution of the Sejm adopted by an absolute majority of votes, as well as the issue of mandatory suspension of him from his duties if the Sejm adopts such a resolution by the said majority. The author shares the Tribunal's position on the second issue, pointing out that the constitutional principle of the independence of the central bank does not allow its president to be suspended by a resolution of the Sejm adopted by an absolute majority of votes in the presence of at least half of the statutory number of deputies, and therefore the same as any stable government majority must have, according to the Constitution. The author takes a critical view of the Tribunal's other findings. In particular, he disagrees with the thesis that it is contrary to the principle of the independence of the central bank to allow the Sejm to indict its president by an absolute majority of votes alone. The author also takes a negative view of the Tribunal's attempt to create a positive norm defining the majority required in such situations.
