Wobec braku oficjalnych statystyk, nie jest możliwe podanie rzetelnej liczby osób transpłciowych w polskich jednostkach penitencjarnych. Jedna z takich osób skierowała jednak skargę do Trybunału w Strasburgu. W dniu 11 lipca 2024 r. ETPC wydał wyrok w sprawie transseksualnej skazanej, orzekając naruszenie jej prawa określonego w art. 8 EKPC. W powiązaniu z najnowszymi zaleceniami CPT poświęconymi tej szczególnie wrażliwej grupie więźniów, zagadnienie stanowi nowe wyzwanie dla władz krajowych na tle poszanowania prawa do prywatności i godności osobistej jednostki. Wytyczne CPT, jak i konieczność implementacji wyroku w sprawie W.W. przeciwko Polsce, powinny być przyczynkiem do zmian w zakresie procedur wewnętrznych SW, a być może również określonych zmian legislacyjnych, zwiększając gwarancje poszanowania praw konstytucyjnych i konwencyjnych transseksualnych skazanych. Artykuł zmierza do przedstawienia najważniejszych tez Trybunału w Strasburgu, treści zaleceń CPT, jak również postulatów w zakresie przyszłych działań poszczególnych organów państwa w tym obszarze.
Abstract EN
In the absence of official statistics, it is not possible to provide a reliable number of transgender individuals in Polish penitentiary units. However, one individual has filed a complaint with the Strasbourg Court. On July 11, 2024, the ECtHR issued a judgment in this case, ruling that her rights under Article 8 of the ECHR had been violated. Alongside the CPT’s recommendations for this particularly vulnerable group of prisoners, the issue presents a new challenge for national authorities, in the context of respecting the right to privacy and dignity. The CPT’s guidelines, as well as the need to implement the W.W. v. Poland judgment, should prompt changes increasing guarantees of respect for the constitutional and convention rights of transgender convicts. This article aims to present the
key theses of the Strasbourg Court’s judgement, the content of the CPT’s recommendations, and proposals for future actions by state bodies in this area.
